Joseph Naham, following the 2011 Tucson shooting -where nineteen people were shot, and six were fatally murdered, made the choice to write to his congressman, Representative Peter T. King(3rd district of NY, Nassau County) Chairman of the Department of Homeland Security, and made a candid request gun control action on that very January 8th, 20011 evening. Mr. Naham thought it was worth his effort to express his concerns so soon to the tragedy to his representative as his Representative had done in the past with the tragic celebrity death of Michael Jackson, where Mr. King announced the media spent too much time reporting about this "Pervert and Low Life ([http://www.youtube.com/watch?v=W-gH2gAXjAw His Own Words])" days after that death. Within 18 hours Two plain clothed SIS officers were deployed to Mr. Naham's home. These two SIS officers were speaking with Mr. Naham's room-mate Gregory Naham at the door, informing him that they were looking for me to discuss my involvement in a crime, and put the officers in contact with Mr. Naham, according to Gregory Naham.
What Mr. Naham was doing with his time before the Tucson Shooting news irked him was working on a legislative proposal for restricting Light Pollution in his town. According to his neighbor, retired Brian Hassett, retired New York Police Department Police Officer. Mr. Hassett along with Mr. Naham had planned to propose this legislation to the town board on January 10th. They made no mention to anyone but each other, and communicated through only email and telephone.
According to Joseph Naham's account of the discussion between himself with the two officers, the officers asked if Joseph had heard of any emails written to Representative King. Joseph responded, "Yes, I wrote him one email asking him to support gun control." The officer's responded "Well they (Mr. King's office) were concerned with your letter, & that's why they sent us. If you could please tone it down.."
Concerned Joseph Naham responded"Are you giving me an ultimatum?"
The officers responded "No, we're not giving you an ultimatum." The conversation concluded with both Joseph and the two officers exchanging Happy wishes for the new year. At the conclusion of the meeting, Gregory asked if Joseph Needed a lawyer, and the officers responded no. The officers expressed that they wanted to see if Joseph was a threat, and they asserted that he wasn't. Gregory followed and said, "So this is all squared away?"
to which the officers replied. "Yes, you won't be bothered again."

The day of the town hall meeting that Joseph Naham and Brian Hassett had been waiting for arrived the following day. Mr. Naham felt embarrassed and didn't confide with his neighbor about the previous day's meeting with the SIS officers as a strategy to not distract Mr. Hassett from the town board. In the past meetings, there had been no security at these town hall meetings according to Mr. Hassett. As soon as Mr. Naham and Mr. Hassett entered the sunroom vestibule of the Town Hall, according to Mr. Hassett's account "Upon entering the building I noticed the "sign in" table was not there and there were several uniformed Town of Hempstead Peace Officers in the hallway near the meeting room entrance. Within five seconds the officers approached Mr. Naham and Mr. Hassett. At this time they were approached by a plain clothes SIS officer who identified himself as a Nassau County Police Detective. .The detective asked Mr. Naham if he had "ID" and asked if he could see it. Mr naham obliged by providing his NYS Drivers License. This Detective then said "Joseph Naham ?" . Mr. Naham replied "Yes." This detective then asked me if I had any identification and I supplied my N.Y.P.D. Retired Identification Card.. The detective then asked if we would both step over into an adjacent corridor to our right. We obliged by walking approximately fifteen paces to this more secluded area that was still in public view. This Detective then asked Mr. Naham "Do you have any weapons on you tonight Mr. Naham?" Mr. Naham replied "No." The detective than asked Mr. Naham if he minded if he searched him. Mr Naham replied "No" and complied with a bodily frisk."

According to Mr. Naham The officers removed his wallet, his cellphone, looked into his cellphone, raised his upper garments up to his chest, asked about the cast around his ankle, what he did for a living, and when the officers were satisfied they returned his belongings.

Mr Hassett reiterated "At about the time that Mr. Naham was removed to be searched, a second detective wearing a suit and tie came into this area and was handed our identification by the plain clothes detective. This detective later identified himself as Detective James McIntosh of The Special Investigations Squad, Nassau County Police Department. Detective McIntosh began to explain that "with all that is going on" the Town Board decided not to hold a public meeting on this particular night. I told Detective McIntosh that "We have no idea what is going on." thinking that there may have been a disturbance in the building that night. Detective McIntosh apologized and explained that in the wake of the recent shootings in Arizona (Rep. Gabrielle Giffords and others days earlier) the Town Board decided not to open their meetings to the public. Detective McIntosh asked me what my relationship was with Mr. Naham. I told Detective McIntosh that Mr. Naham was my neighbor. Detective McIntosh then explained that Mr. Naham had written an e-mail that while it did not support probable cause for arrest it did warrant concern. Detective McIntosh did not say who the e-mail was addressed to."

Later Mr. Naham spoke with a source with connections to Mr. King's office (who would like to be left anonymous for personal reasons) and the source divulged that the meeting had in fact been cancelled because King's office had found at Mr. Naham was going to be attending, and apparently Mr. King's daughter coincidentally was attending as well.
"There are reports of hacking abuse in the United Kingdom by the media, but what about half hazardously hacking and violating the rights of citizens by our own government? Representative King acted like someone who doesn't believe in a democratic society, and we should hold the office's of these manipulative politicians as accountable as the corrupted ex-employees of News Corp, which incidentally Mr. King exclusively is a guest on! Since that week I've had my cellphone's voicemail full of 10 minute long empty messages Every Single Day! It's only been since that week, and when I delete all 20 of these messages with no missed calls, sure enough within 6 hours; my voicemail is cluttered with these dispensable messages. I am forced to speculate that it's an independent device used to either hack into my location, or tap into my phone conversations!" Exclaimed Mr. Naham.

"I am alarmed by the unwarranted detaining of myself and Mr. Naham on the night of January 10, 2011 by the Nassau County Police Department. I am especially alarmed by the subsequent bodily frisk of Joseph Naham. Obviously neither myself nor Mr. Naham displayed any indication that we had just committed a crime or were about to commit a crime, the paramount legal standard for such a "stop, question and frisk." Although Mr. Naham consented to the bodily frisk there was no legal basis for the initial "stop" in my professional opinion.

A copy of Mr. Naham's email was faxed to Gregory Naham's acquaintance, and first amendment attorney Patrick English, who is credited with winning a high profile first amendment case for PentHouse magazine against Kodak in 1980. After reviewing the email Mr. English assessed that there wasn't anything threatening about this email.

Gregory, and Joseph Naham, and Mr. Hassett jointly concluded that "Obviously someone in Mr. King's office used very poor judgement in this instance. This was the catalyst for another example of poor judgement by the Nassau County Police Department. Fortunately this chain of events ended abruptly without the tragic ending we so often read about. Unfortunately it led to our civil rights being violated."

Is is acceptable for a Congressman's office to waste tax payer money to cancel an unrelated public town hall meeting without any threat issued?
Do you think that if the government is making half-hazzourdly decisions to hack into phones, and cancel town meetings without threats issued, than they hypothetically may be including your name in a file which may be used against you in the court of law in the future?

I know a longer letter would probably make a better impact, and hold more resonance with you who reads this, or whomever reads this. I am more concerned today than ever, even more than 9-11(I was born in NYC & lived in Long Island al my life.I still grieve the loss) . On 9-11 our private citizens were lost sir, and finally 2 weeks ago our first responders received funding for medical aide. I don't want to see that good deed overshadowed with a severely wrong deed. Sir,The tragic incident in AZ today is unquestionably going to catalyst the fearful Congressmen and congresswomen to permanently quarantine, and physically isolate, themselves from the people that elected them. I would like to meet with you sir. I know that you're interested in McCarthystic interrogations, but that mechanism won't result in the Positively. It will actually contradict what our nation's applied with foresight from hindsight in terms of gun control, and higher standards for freedom and security. Unless you allow the congress to isolate itself as a nepotist for the NRA's agenda I beg you to listen to reason. The NRA won't show you social results, only abstract results.. The energy of this country should not be focused on isolating our elected officials ( I hope you agree with me on that), and not focused on suppressive hearings echoing from the fearful days of McCarthy.On the top of my list is praying for the families of those affected by this incident. My sympathies go out to them. I want this to never to happen to anyone ever again. and not just to congress, but to everyone. I'm completely genuine with what I'm saying Sir. As we've seen with the Bush Presidency and the unfavorable results of Presidents kept inside a bubble we can't let our congress be coddled into that same unfortunate environment. God Bless America.
